Game Wardens have "special powers" that regular police do not have. Now one could always argue in court if fined but..

View attachment 393553

Part of the agreement when purchasing a TN Hunt Fish combo license is to comply with all requests from Game Wardens while on State property/ jurisdiction. Hence buying the license is optional as is agreement to those terms. Probable cause and 4th Amendment was shoved up your bung hole when you checked the box to comply upon purchasing permit.

Yep and that will be the big difference between windrock and the WMA. Windrock will take your permit and ban you. TWRA will take you to jail if they want.

Game wardens are police officers. They are agents of the government. While they may have some DIFFERENT powers compared to a police officer or sheriff's deputy, they do not have the authority to violate Constitutionally protected rights. Point being, the same protected rights apply when dealing with any government agent acting in their legal capacity.

All lawful requests.

while on State property/ jurisdiction. Hence buying the license is optional as is agreement to those terms.

That's called informed consent. You are voluntarily consenting to a warrantless search in advance.

Probable cause and 4th Amendment was shoved up your bung hole when you checked the box to comply upon purchasing permit.

It wasn't shoved up your ass. You CONSENTED to it, just like you can (verbally) consent to a search by any other LE officer.

Is having alcohol a misdemeanor or a civil infraction on TWRA land? I don't know TN laws.

If a CI, then they can't arrest you. If a misdemeanor, they can (but generally won't).

Reserve/helper isn't that the same thing?
You're welcome to call it whatever you like. We had the majority of the same powers as full time certified, but only when on duty. My department required reserve officers to to complete the academy, qualify (firearms) 2x annually, and complete all the same in-service training as the FT officers. We couldn't perform road patrol solo, but served as a second officer in the car - which is especially useful for jurisdictions that do not have the tax base to support a large number of full-time officers.

In some states, reserve and full-timers are no different. Essentially, part-time vs full-time.

Doesn't the Idaho killer suspect have a degree in Criminal Justice?
I haven't followed that case very much.

That said, I would be willing to bet that there have likely been people from almost every profession and with most every type of degree that have murdered other people.

99% sure this is only a Civil Infraction/ Regulation violation- fine only.

There is a TN state law on the books prohibiting camping on state property ( Thanks to Memphis slums- think Portland) but then TWRA designates the North Cumberland WMAs all can camp anywhere, so the local regulations roll back the State law via designation.

I'm sure there is the same laws for operating a motor vehicle while under the influence, ergo doesn't matter if it's a car on the road or UTV on the trails, can't operate under the influence or have open containers, etc.

We been lucky they just didn't enforce it "at all" for the past 20 years. But we have had 6 alcohol related fatalities with OHV in North Cumberland WMA this past year alone.

Damn Yankees and carpetbaggers can't hold thier liquor or trash for that matter and screw it up for everyone.
